Dear Pamela,

Most of the paperwork for a divorce is filling in the blanks. However, a Judgment must be written carefully so that all the transfers of property can be carried out by order of the court. The pension/retirment money will be worth more than what was actually put in, and depending on the kind of account, might need a qualified domestic relations order to divide.

And you must pay attention to the requirement disclosure of all assets, obligations, earnings and expenses by one spouse to the other. Not information that gets filed with the court; it is between the two of you, and there can be heavy penalties for not doing so.

Should you file? There’s no advantage to being petitioner or respondent. The cost in filing fees is $395.
